1. Definitions

In these general terms and conditions the following terms have the following meanings:

 

  1. Reflection period: period within which the client can make use of their contract .

  2. Client: natural person, not acting in the exercise of a profession or business and who enters into a distance contract with Lovecreation.

  3. Day: calendar day.

  4. Right of withdrawal: right of the consumer to withdraw from the distance contract within the specified reflection period.

  5. Lovecreation: the platform that offers products design services to client from a distance.

  6. Distance contract: contract between the client and Lovecreation, established at a distance by using a system intended for that purpose.

  7. In writing: In writing is also understood to mean electronic communication, such as e-mail, provided that the identity of the sender and the authenticity of the communication are sufficiently established.

2. General

  1. These general terms and conditions apply to every offer from Lovecreation and to every distance contract concluded between Lovecreation and other parties.

  2. The agreement is concluded when the consumer accepts Lovecreation's offer and meets the conditions set for that offer.

  3. Lovecreation will immediately confirm receipt of the acceptance of the offer. Until Lovecreation has sent this confirmation, the consumer can dissolve the agreement.

3. Right of withdrawal

  1. The buyer has the right to dissolve the agreement without giving any reason within 14 days after the agreement

  2. If the consumer wishes to make use of the right of withdrawal, he must notify us in writing within the reflection period. We will immediately send a confirmation of this message.

  3. Lovecreation will reimburse the payments received from the buyer within fourteen days after dissolution.

4. Exclusion of the right of withdrawal

  1. The right of withdrawal is generally excluded for the following products:

  2. that have been created by Lovecreation in accordance with the consumer's specifications;

  3. that are clearly personal in nature;

  4. that cannot be returned due to their nature;

5. Delivery 

  1. Digital products, design and documents to be sent by email or post

  2. The place of delivery is the address that the consumer makes known to Lovecreation

  3. Physical items like products, prototypes to be sent by third-party carriers service.

  4. Temporary and permanent installations to be shipped to the event place 

6. Warranties and Conformity

  1. Only Dutch law applies to agreements between Lovecreation and other parties

  2. Complaints about the implementation of the agreement must be reported fully and clearly described in writing to Lovecreation within a reasonable time, but no later than 14 days after the consumer has discovered the defects.

  3. Complaints submitted to Lovecreation will be answered within 14 days of receipt of the complaint. If the complaint cannot be resolved within 14 days, Lovecreation will report this in good time and give an indication of the period within which the consumer can expect a solution.

  4. Lovecreation informs the consumer of the possibility, if Lovecreation and consumer do not reach a solution together, within 12 months after reporting the complaint to Lovecreation, to submit the complaint to the Online Dispute Resolution of the European Commission

7. Complaints and Disputes

  1. Lovecreation offers no (additional) guarantees with consult to the nature of the product.

  2. The client must store and use the products in accordance with the storage advice of Lovecreation. 

  3. Products must meet the reasonable expectations of clients.

  4. If a defect turns out to be a fault existing at the time of purchase, the consumer is entitled to a replacement of the product. Only when the product is no longer produced or if the replacement exceeds the value of the product to an unreasonable degree, Lovecreation may offer to reimburse the purchase price to the consumer.

  5. Compensation, repair or replacement due to the defect in a product will lapse if the defect has arisen as a result of or results from careless, injudicious or improper use thereof or use after the expiry date, incorrect storage or maintenance by the consumer.
